Scammer Jessica Yaniv Simpson, aka Jessica Serenity Simpson, has filed a lawsuit against the driver and owner the car that barely crashed into them in September 2020, alleging they’ve caused lifelong and irreversible damages.
I want to preface this entire story with some pictures of Jessica’s car, post collision.
The car was a write-off, but that doesn’t take much. The book value of a low end 2009-era Corolla is sub-$10,000, and it takes nothing to reach $10K in damage on modern cars. A trunk lid, rear bumper cover, fenders, paint, etc. Body shops don’t bang out dents, especially in plastic. Panels are replaced and painted these days.
That isn’t to say the collision was serious. It certainly happened, and we have the video, but it was minor by every measure.
Here’s what JY was posting to social media in the days after. You can clearly see he’s been setting this scam up since day 1.
I also think it’s important to raise the question about whether or not JY caused the collision. I’m not saying he did, but he’s a notoriously dangerous driver, and a well-known scammer. Could he have slammed on his brakes? Yes, technically still the person’s fault for rear-ending him, but he may have influenced it.
Now, this lolsuit…
JY has filed the lawsuit against the driver, E. Cumyn, and the vehicle owner, Southwestern Flowtech & Environmental Ltd. In it, JY alleges that Cumyn was driving too fast, failing to keep a proper lookout, driving without brakes or without using the brakes, failing to keep a vehicle under control, fail to take precautions to avoid collisions, failing to stop or slow down to avoid a collision, failing to ensure the vehicle was mechanically sound, driving a vehicle while knowing it may be mechanically unsound, driving without due care or attention, and following too closely. In other words, every boilerplate cause of a collision he could possibly squeeze in.
As a result of the above, JY alleges he suffers from, and will continue to suffer from physical and mental injuries including (are you ready?)…
- head
- neck
- shoulders
- arm, wrists, hands, and fingers
- back
- hips
- legs
- pelvis
- headaches
- migraines
- fatigue
- insomnia
- learning disability symptoms
- anxiety
- depression
- memory difficulties
- sleep difficulties
- dizziness
- concussion and post-concussion symptoms
- vision difficulties/photophobia
- chronic widespread pain
- psychosocial and behavioural changes
- other injuries that may develop or become known in the future.
Let that soak in a little.
There’s a million things we could say about that list but I’ll leave it at this: virtually every one of those claims is entirely medically unprovable and relies solely on his word to support it.
His scamsuit goes on to claim that the injuries have and will continue to cause suffering, loss of enjoyment of life, permanent physical disability, loss of earning capacity, past and future, and loss of housekeeping capacity, past and future. He adds that he’ll be more susceptible to future injuries and degenerative changes because of this.
I’m going to leave that little tidbit for our friends in the comments. Yikes.
Lastly, JY says he has sustained damages for the cost of medical treatment, and will continue to do so, and that his family members have to care for him now.
And now I’m going to weigh in with my opinion…
JY, a known scammer and con artist, has filed a lawsuit alleging a driver did every copypasta bad thing he could find and crashed into him, causing every unprovable medical ailment he could possibly tie to a collision of this nature. He goes on to claim it’s cost him money, and that his dear family has to look after him, and he can’t clean his house because of it. He left out the fact that he was a fat slob before this, and he’ll be a fat slob forever, and his only family has been living their best lives since he was banned from their condo.
JY says he lost earning potential, while leaving out the fact that he’s basically never held a real job for more than a few months because he’s too stupid and creepy to do it. He leaves out the fact that he has never had a viable social life, and has always had learning disabilities, and required special ed in school. Instead, he says the driver that crashed into him hit him so hard it whacked his brain and social skills into another dimension.
Sure.
JY’s claim was filed in BC Supreme Court by what appears to be a reputable class action and injury law firm Slater Vecchio LLP of Vancouver. To me, this says one of two things. Either the firm believes he has a case and has taken it on a contingency basis, which I think is unlikely, or JY has paid them to file a lawsuit on his behalf, hoping to intimidate the defendants into a quick settlement instead of going up against a big law firm. This is more likely to me.
JY is unlikely to have put up enough money up front to secure their services through a trial, which would easily exceed $50,000. I would bet that he put up a minimum hoping they would file for him and try to look tough, and that’s that.
It’s also worth bringing up that BC’s government insurance agency ICBC isn’t referenced here. ICBC switched to a no-fault model after this collision, which leaves the door open for a lawsuit for JY, but ICBC is still likely to step in for the defendant and they are very, very good at dealing with these kind of scams. An entire post could likely be made about ICBC, but I’m not an expert and leave that to the comment section.
For an award, JY asks for “general damages, special damages, interest”, and a trust fund award for past and future services by family members. I suspect he’s been reading too big legal cases and trying to apply it to his own.
Maybe he does have some mental disabilities after all.
