This fax came in June 25th. It is the missing part of the foreclosure update from June 24th. The Statement of Relief Sought by Alta West Mortgage Capital Corp is posted below. A MeowMix Agent purchased these documents.
Payout Statement
The lender requires Yaniv pay $338,142.00 (Canadian funds) on July 10th by certified cheque. Also, if Jon doesn’t pay that day, they will add daily interest at $109.79 per day starting July 10 after 12PM MST.
This statement shows Jon owes $318,552.88 for the mortgage balance at Feb 28th. Owes accrued interest of $16,018.38 to July 9th. Furthermore, the statement also requires Jon to pay $650 owed to the Hawthorne Property Management and $2,920.74 which appears to be unpaid Condo fees. The legal end of things for Alta West is being handled by Owen Bird Law Corporation. The lawyer has a large winning list of cases on his profile.
Jon is self representing. He thinks he can argue for 2+ hours of the court’s time. Reality is, Jon owes Alta West for the mortgage.
Jon owes money to his strata. He owes money to the PHSA for knowingly false accusations. Jon owes money to Hung Long for his racist “service dog” grift.
He owes an apology to the world for every grift and lie and deceitful thing he has done.
Costs
The interesting bit of the Statement of Relief Sought is #5 Costs. Scale A and Scale B were not included in the documents MeowMix received. However, it is of interest that COSTS are being proposed and MM assume will be determined July 10.
The total owed beyond $338,142.00 (payout statement items) could be more, if the judge decides to award Alta West costs that they are seeking. I would assume that they are requesting the cost of extra time wasted on attempts to serve Jon, which he evaded. Extra costs for more lawyer fees for arguing with the numpty would be a valid request.
Odds are though, Jon doesn’t have the $338,142.00 by July 10th. Unless you see a listing for his condo for sale tomorrow, and even then, it is highly doubtful he would sell and close the deal before that date. Alta West are allowing Jon the option to sell the unit himself and pay them out.
Odds were Jon wouldn’t. It’s Jon after all.
Order for Sale by Petitioner
To summarize, when a property owner defaults on their mortgage, the lender can petition the court to order a sale of the property to recover the debt. As you can see by #7 on the Statement of Relief Sought that Alta West are not requesting it at the July 10th hearing.
Odds are Alta West will have to request the court give them the Order for Sale by Petitioner – when Jon refuses payment on July 10th.
